Important contextFirst — what we host.
Vibes does not host audio files. Songs play from Apple Music or Spotify, both of which are properly licensed. The only user-generated content we host is:
— A short text note that travels with each shared song (max 280 characters)
— A user's display name and bio
— A user's profile picture
If your DMCA concern is about audio, it almost certainly belongs to Apple or Spotify rather than us — go to whichever platform owns the rights. If your concern is one of the three things in the list above, the procedure below applies.
Filing a notice
What to send. In one email.
Send a single email to dmca@vibes.app with the following — required by 17 U.S.C. § 512(c):
1. Identification of the copyrighted work. What you own. A registration number is helpful but not required.
2. Identification of the allegedly infringing material. The exact URL, username, or content ID. Screenshots help.
3. Your contact information. Name, address, telephone, email.
4. A statement that you have a good-faith belief that the use is unauthorized. Verbatim from the statute is fine.
5. A statement, under penalty of perjury, that the information is accurate and that you are authorized to act on behalf of the owner.
6. Your signature. Electronic signature is fine.
We process every notice within 5 business days. Most are processed within 24 hours.
Counter-notice
If we got it wrong.
If your content was removed and you believe it was a mistake (you actually own it, you have a license, your use is fair use, etc.), file a counter-notice to dmca@vibes.app. The counter-notice must include:
— Your contact info.
— Identification of the removed material and where it appeared.
— A statement under penalty of perjury that you believe the removal was a mistake or misidentification.
— Your consent to jurisdiction in U.S. federal court for your district (or, if outside the U.S., the Eastern District of New York).
— Your signature.
If we receive a valid counter-notice, we'll forward it to the original notifier and restore the content within 10–14 business days unless they sue. We will tell you when we restore.
Repeat infringers
Three strikes. Then a ban.
In accordance with 17 U.S.C. § 512(i), Vibes terminates accounts of repeat infringers. Three valid notices against the same account in a rolling twelve-month window result in a permanent ban. We notify the user before termination.
A "valid notice" is one that resulted in content removal and was not subsequently reversed by counter-notice.
Designated agent. Per 17 U.S.C. § 512(c)(2), our designated DMCA agent is registered with the U.S. Copyright Office. Contact: dmca@vibes.app. We update the registration annually.
